Welcome to Nepsis. These Terms of Service govern your access to and use of the Nepsis mobile application. By downloading, purchasing, accessing, or using Nepsis, you agree to these Terms. Please read them carefully.
By accessing or using Nepsis, you confirm that you are at least 13 years old and legally able to agree to these Terms. If you are under the age of legal majority where you live, you must have permission from a parent or legal guardian.
If you do not agree to these Terms, please do not purchase, access, or use the app.
Nepsis is a calm and meditation application offering visual, sound-independent, and nature-based experiences intended to support relaxation, stillness, mindful awareness, and personal well-being.

Some content may require an internet connection because videos, images, written guidance, or other materials may be delivered from online services.
Nepsis is provided for general relaxation, mindfulness, and personal wellness purposes only. It is not a medical application or healthcare service and does not provide medical advice, diagnosis, therapy, treatment, or emergency assistance.
Nepsis is not intended to diagnose, treat, cure, or prevent any medical or mental health condition. The app is not a substitute for professional medical care, mental health treatment, or advice from a qualified healthcare provider.
You are responsible for deciding whether an experience is suitable for you. Do not force, strain, or hold your breath beyond what feels comfortable. Stop an experience if you feel dizzy, short of breath, distressed, uncomfortable, or unwell.
Consult a qualified healthcare professional before using breathing, movement, or relaxation practices if you have a medical condition, breathing condition, are pregnant, have recently had surgery, or have any concerns about participating safely.
Do not use Nepsis while driving, operating machinery, or performing any activity that requires your full attention. If you believe you are experiencing a medical or mental health emergency, contact local emergency services immediately.
Purchases made through the Apple App Store or Google Play are subject to the refund rules and decisions of the applicable store. Nepsis does not independently control or guarantee approval of refund requests processed by Apple or Google.
To request a refund, use the refund process provided by the store through which you completed your purchase. Nothing in these Terms limits any refund or cancellation rights available to you under applicable law.
If you previously purchased access, you may use the Restore Purchases option in the app to attempt to restore your entitlement without paying again.
Restoration may require you to use the same Apple or Google account used for the original purchase. Purchase restoration and transfers between platforms are subject to store restrictions and successful verification of the original transaction.
Deleting your Nepsis account does not automatically cancel or refund a purchase made through Apple or Google. Store purchase records are managed separately by the applicable platform.
We may add, update, rename, reorganize, replace, or remove app features, visual experiences, written guidance, videos, images, or other content as Nepsis develops.
We do not guarantee that every feature or item will always be available, uninterrupted, or identical to an earlier version. Temporary interruptions may occur because of maintenance, technical problems, internet availability, third-party services, or circumstances outside our control.
You agree not to:
Nepsis and its content—including its name, logo, branding, interface, software, written guidance, visual designs, illustrations, images, videos, animations, graphics, and overall presentation—are owned by or licensed to Nepsis and are protected by applicable intellectual property laws.
Your purchase gives you a personal, limited, non-exclusive, non-transferable, and revocable right to use Nepsis for your own non-commercial purposes. It does not transfer ownership of the app or its content to you.
Nepsis may rely on third-party services for functions such as app distribution, authentication, purchase verification, cloud storage, database access, video delivery, analytics, or technical infrastructure.
Your use of Apple, Google, Firebase, RevenueCat, or other third-party services may also be governed by their respective terms and privacy policies. Nepsis is not responsible for outages, policy changes, or actions controlled solely by those third parties.
To the fullest extent permitted by law, Nepsis is provided on an “as is” and “as available” basis. We do not guarantee that the app will always be available, uninterrupted, secure, error-free, or compatible with every device.
We make no promise that using Nepsis will produce a particular emotional, physical, therapeutic, spiritual, or wellness result. Individual experiences may vary.
To the fullest extent permitted by applicable law, Nepsis and its owner, operators, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your access to or use of the app.
This includes, without limitation, damages resulting from loss of data, inability to access the app, reliance on app content, interrupted services, device incompatibility, or third-party services.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
We may suspend or terminate access to Nepsis if we reasonably believe that a user has violated these Terms, misused the app, attempted to bypass payment or security protections, or engaged in unlawful activity.
You may stop using Nepsis at any time and may delete your account through the app. Provisions concerning intellectual property, disclaimers, limitations of liability, and governing law will continue to apply after termination where appropriate.
We may update these Terms when Nepsis features, legal requirements, business practices, or third-party services change. The updated version will be posted with a revised effective date.
Where required, we will provide additional notice of material changes. Your continued use of Nepsis after updated Terms become effective constitutes acceptance of those Terms.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, except where consumer protection laws in your place of residence require otherwise.
